ANDERSON BILL TO PROTECT PRIVACY IN DIVORCE CASES IS SIGNED BY GOVERNOR

SB 340 Protects Private Financial Data in Family Law Cases Where the Responding Spouse Cannot Be Located

July 4, 2015 (San Diego)--Senator Joel Anderson (R-Alpine) has announced that his bill, SB 340 was signed by Governor Brown. The measure allows courts to protect people from having to send highly confidential and personal financial information out when it is clear that the intended recipient is no longer at the last known address.

Before SB 340, each spouse in a dissolution or legal separation case had to provide the other side with detailed financial information, known as financial disclosures, at least once. Because the disclosures must be mailed to the last known address, there was the worrying possibility that a third party may come into possession of the Petitioner’s sensitive financial information.

Under the new law, if a respondent defaults on a court summons in a divorce case, the petitioner does not have to serve a final declaration of disclosure.

The bill passed both houses of the legislature with unanimous bipartisan support.

Anderson said, “It's important we protect privacy of our citizens while making sure our legal system is working efficiently. Now, Californians’ confidential financial information is better protected from falling into the wrong hands.”
