April 15, 2009 (La Mesa)—La Mesa police have arrested Garth Gumienny, 35, a convicted child molester found to be living with a young boy who he repeatedly molested. The child was the son of Gumienny’s roommate, according to La Mesa Police Captain Ed Aceves.

“The mother did not know the sexual abuse was occurring,” Aceves told East County Magazine. The mother was also unaware that Gumienny was a registered sex offender. “As for the child, he will stay in the home with his mother.” Periodically detectives from La Mesa Police Department conduct compliance checks of all the sex registrants that live in the City of La Mesa. These compliance checks are conducted to verify that the registrant still lives in the City of La Mesa at their listed registered residence and are in addition to the annual registration requirement. Per State law sex registrants are required to register with the police agency within the city they reside. If a registrant moves to a new city they are required to register with the police department in the new city within 5 days. Failure to register with the police agency on an annual basis may be a felony, depending on original charge. On April 14, 2009, La Mesa Police detectives were conducting compliance checks of all 77 sex registrants. While conducting a check in the 4500 block of Parks Avenue, detectives found Gumienny staying in a room with a young boy. Detectives interviewed the young boy and discovered that Gumienny had sexually molested him numerous times while living at the residence. Gumienny was arrested and booked into San Diego County jail for 10 counts of 288(a) PC Child Molest. Gumienny is a sex registrant for being convicted of similar crimes.
