BIDEN ADMINISTRATION TAKES STEPS TO PROTECT SOME ABORTION ACCESS, LAUNCHES WEBSITE TO HELP WOMEN FIND REPRODUCTIVE CARE

July 21, 2022 (Washington D.C.) – After the Supreme Court ruled that states can ban or restrict abortion access, overturning Roe v. Wade, the Biden administration has taken several actions to protect abortion access in certain circumstances. Specifically:

  • The administration cited a law on the books since 1986, the Emergency Medical Treatment and Active Labor Act (EMTALA), which requires abortions be allowed in all states if a woman’s life or health is at stake; hospitals that refuse can lose Medicare and Medicaid funding.
  • The Health and Human Services (HHS) Department warns that pharmacists must dispense medications used for miscarriages and early-term abortions, or face potential criminal penalties. Attorney General Merrick Garland similarly issued a statement that states cannot ban mifepristone, a drug approved by the FDA for early pregnancy termination among other uses.
  • HHS launched a website to help people nationwide find reproductive care and understand their rights at https://reproductiverights.gov/
  • President Joe Biden signed an executive order to protect patient privacy and access to emergency contraception and medication abortions.
  • HHS has advised pharmacies not to discriminate based on types of contraception sold, if any birth control items are sold in their retail stores.

April 7, 2021 (Washington, D.C.) - U.S. Department of Health and Human Services (HHS) Secretary Xavier Becerra today announced that all HRSA-funded health centers and Health Center Program look-alikes (LALs) will now be invited to participate in the Health Center COVID-19 Vaccine Program. These health centers will have the opportunity to join the program as soon as they are ready, increasing the total number of health centers that have been invited to 1,470 nationwide. This expansion will be made through the Health Resources and Services Administration (HRSA) and the Centers for Disease Control and Prevention (CDC).

ATTORNEY GENERAL: TRUMP SENT FALSE INFORMATION ABOUT CALIFORNIA MAIL-IN BALLOTS TO VOTERS

September 17, 2020 (Sacramento) – California Attorney General Xavier Becerra warns that voters in California have been sent a mailer by the Trump administration stating that mail-in ballots must “be requested” and that voters must “add postage to the return envelope if needed.” Both statements are false.
 
“Both statements could lead to voter confusion. In California, mail-in ballots will be sent automatically to registered voters starting October 5th — and postage is not needed to return your ballot in our state,” Attorney General Becerra says.

February 25, 2020 (San Francisco) – By a 7-4 vote, the Ninth Circuit Court of Appeals yesterday ruled that federal Title X funds for family planning can be blocked to any clinics that provide abortion referrals, even if they don’t perform abortions.  
 
California Attorney General Xavier Becerra called the ruling troubling” adding, “The gag rule interferes with healthcare decisions that should remain between women and their healthcare providers. This reckless rule is just another attempt by the Trump-Pence administration to roll back women’s access to reproductive healthcare.”

CA ATTORNEY GENERAL SUES NEPTUNE SOCIETY, ALLEGES “SWINDLING” OF CUSTOMERS WHO PREPAID FOR CREMATION SERVICES

December 7, 2019 (San Francisco) --  California Attorney General Xavier Becerra, along with the District Attorneys for the City and County of San Francisco, Alameda County, and Marin County, filed a lawsuit yesterday in Alameda County Superior Court against Texas-based Service Corporation International and its subsidiaries doing business as Neptune Society.
 
The lawsuit alleges that Neptune — a company offering pre-need cremation service plans for purchase prior to a customer’s death — engaged in unlawful business practices. The lawsuit includes allegations that the company broke California law by failing to hold in trust for the benefit of its customers a substantial portion of the money they paid for these plans and that it misled customers concerning this illegal practice.

ATTORNEY GENERAL BECERRA OBTAINS $1.5 MILLION IN JUDGMENTS AGAINST TELEMARKETERS WHO SCAMMED VULNERABLE INVESTORS

May 29, 2019 (Sacramento) - California Attorney General Xavier Becerra announced today judgments totaling $1,498,574 in a lawsuit against telemarketers who scammed investors. The company, Consumer Rights Legal Services (CRLS), and four individuals, including CRLS’s president and owner, James Davitt, cheated more than 150 victims by offering bogus “investment recovery services” that they claimed would recover money victims had lost from previous investments. Many of the victims were elderly and had already lost hundreds of thousands of dollars from previous schemes.

ATTORNEY GENERAL BECERRA ANNOUNCES SENTENCING IN $4 MILLION SOUTHERN CALIFORNIA MORTGAGE FRAUD SCHEME

February 13, 2019 (San Diego) - California Attorney General Xavier Becerra today announced the sentencing of Prakashumar ("Kash") Bhakta for operating a mortgage fraud scheme throughout Southern California and the Inland Empire that preyed on homeowners facing foreclosure. Today, Mr. Bhakta was sentenced to seven years and eight months in state prison. Restitution will be ordered in the amount of $256,000. Co-defendants Jacob Orona, Aide Orona, John Contreras, Marcus Robinson, and David Boyd previously pled guilty. They were sentenced to state prison terms ranging from four years to seven years and four months.

CALIFORNIA POLITICANS REACT TO TRUMP ORDER ON FAMILY SEPARATION; STATE FILES LAWSUIT

June 21, 2018 (San Diego) – East County legislators and California’s state attorney general are taking action in response to President Donald Trump’s executive order to end separation of immigrant children and parents. Some argue that the directive does not go far enough to protect children and babies, since they could still be detained with parents and since it’s unclear how or when youngsters already taken from parents will be reunited.

Trump's reversal came after audiotape of terrified, crying children at a detention facility was released by ProPublica and after a judge sharply criticized the Trump administration upon learning that records were not kept when some children were taken from their anguished parents, who have been unable to get any information on their children's whereabouts 

"I can’t understand this," the exasperated judge reportedly told the attorney. "If someone at the jail takes your wallet, they give you a receipt. They take your kids, and you get nothing? Not even a slip of paper?”

CALIF. COURT ISSUES NATIONWIDE INJUNCTION TO PROTECT DREAMERS

 

 

Attorney General Becerra helps secure victory for Dreamers as court blocks implementation of Trump Administration’s rescission of DACA until a final decision is reached in the litigation

January 10, 2018 (Sacramento) – A California court has issued a nationwide injunction to temporarily protect Dreamers, or young people brought here as children of undocumented immigrants, or young people brought here as children of undocumented immigrants, before a Trump administration order forces them to be deported. Trump rolled back DACA, the Deferred Action for Childhood Arrivals executive order issued by Barack Obama.

Congress is grappling with legislation that could permanently protect the Dreamers. But  the clock is ticking. President Trump has indicated he is open to a bill to protect the Dreamers, but only if it also includes funding for a border wall.  While Democrats and some Republicans support protection for dreamers, hard liners in the Republican Party oppose it and its unclear whether Democrats would back billions to build a border wall.

October 19, 2017 (San Francisco) — President Donald Trump’s executive order to cancel cost-sharing subsidy payments required by the Affordable Care Act passed by Congress is being challenged in court by California Attorney General Xavier Becerra.  Becerra has filed a motion asking the court to compel the federal government to “follow the law and pay the subsidies that millions of Americans rely on to lower the out-of-pocket costs in their insurance plans,” according to a press release issued by his office.

June 15, 2017 (Sacramento) - California Attorney General Xavier Becerra today issued a consumer alert to warn Californians about a tobacco scam circulating on the internet. The scam suggests individuals can sign up to receive payments under the Tobacco Master Settlement Agreement. This is false, as individuals are not entitled to receive payments under the Agreement, which is between state governments and tobacco companies. All payments under the Settlement are made to state and local governments.

April 8, 2017 (Sacramento) -- California Attorney General Xavier Becerra, along with 15 fellow attorneys general, filed a friend-of-the-court brief in the case Planned Parenthood of Greater Ohio et al v. Hodges before the Sixth Circuit United States Court of Appeals on Thursday. The amicus brief defends a woman's right to access essential healthcare services, including reproductive health services, and a qualified healthcare provider's right to participate in offering publicly-funded health services to all people.
